i complained to the city of tempe that their erecting christian displays on the tempe butte during christmas and easter violated both the 1st amendment of the us bill of rights and Article 2 Section 12 of the arizona constitution both which forbids the government from spending money on religion.

the city attorney of tempe Brad Woodford sent me this email that said ANY group can erect symbols on the tempe butte for free (execpt for the cost of electricty to light them).

here is what we have to do to erect a anti-war sign on the tempe butte next to sun devil stadium. im an extremist and would like a sign that says something like

bush is war criminal end the war in afganistan

placed on the tempe buttes. but i suspect the other people in the group will settle for something a little more consertive such as a peace sign being placed on the butte.

The City of Tempe's policies and procedures for erection of non-commercial symbols upon Hayden Butte are as follows:

Private parties wishing to display symbols on the butte must obtain a permit from the Community Services Department of the City of Tempe. All expenses of the erection of the symbol, the symbol itself, and any utilities required to power the symbol are provided by the private parties.

The only fee charged is for the use of utilities through a City utility connection. The duration of the display is approved in the permit process, however they must be erected in a safe manner. Symbols have been erected for many years at various times but generally around holiday seasons.

You may obtain copies of the permits that hav been issued by contacting Mark Richwine @ 350-5325.

It is my opinion that the display of such symbols by private parties does not violate either Federal or State constitutional or statutory law.
